Terms of Service

These Terms govern your use of softspawt.com (the “Service”) operated by Softspawt. By using the Service or placing an order, you agree to these Terms.

1. What we do

Softspawt takes a photo you upload and generates a real-time AI preview of a custom plush pillow. If you place an order, our designer hand-finishes the artwork and we manufacture and ship the product to you. Products are made-to-order based on your approved design.

2. Pricing & payment

• Prices shown on the site are in USD and do not include taxes or shipping unless stated.
• We currently confirm orders by email and collect payment via secure third-party processor (Stripe). Card data is processed by Stripe; we never see or store full card numbers.
• By placing an order you authorize us to charge the agreed total to your payment method once your design is approved.

3. The preview vs. the final product

The AI preview is a representation, not a contract. After ordering, our designer reviews and hand-finishes the final artwork. We do not begin production until you approve the hand-finished proof by email. The finished product will closely match the approved proof but may differ slightly in color or detail due to fabric, printing, and lighting variation normal to physical manufacturing.

4. Production & shipping

• Typical timeline from approved proof to delivery: 7–21 days, depending on destination.
• Shipping is handled by international carriers; tracking will be provided by email.
• Import duties / taxes (if any) are the recipient's responsibility and may apply in some destination countries.

5. Refunds & returns

Because every product is custom-made to your approved design, refunds are limited:

• Defective or damaged products: contact us within 14 days of delivery with photos. We will reprint or refund at our discretion.
• Lost in shipping: we will replace lost orders confirmed by the carrier.
• Buyer's remorse on a correctly produced custom item: not eligible for refund. We strongly recommend approving the proof carefully before production.
• Order cancellation: orders can be cancelled for a full refund within 24 hours of placement or before you approve the proof, whichever is earlier.

6. Your photos & intellectual property

• You retain all rights to photos you upload. You grant Softspawt a non-exclusive license to process those photos solely to provide the Service (generate the preview, hand-finish the artwork, manufacture, and ship the product).
• You confirm that you have the right to upload each photo (you own it, took it, or have permission to use it). You agree not to upload photos that infringe a third party's rights, including photos of public figures or celebrities, copyrighted artwork, or images you do not have permission to use.
• Softspawt retains rights to its brand, website design, the AI engine logic and prompts, and any sample / example artwork on the site.

7. Acceptable use

You agree not to use the Service to:

• Upload illegal, obscene, hateful, or copyrighted material you do not own.
• Attempt to overload, scrape, or reverse-engineer the AI generation system.
• Resell or commercially redistribute the previews without an order.

8. Limitation of liability

To the maximum extent permitted by law, Softspawt's total liability for any claim arising from the Service or an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages.

The Service is provided “as is”. The AI preview may occasionally produce unexpected results; this is the nature of generative AI and is why a designer reviews every final piece before printing.

9. Governing law

These Terms are governed by the laws of Hong Kong SAR. Any dispute will be resolved in the courts of Hong Kong, except where local consumer protection law of your country applies.

10. Changes

We may update these Terms. We'll change the “Effective” date above and, for material changes, notify you via the website or email. Continued use of the Service after changes means you accept the new Terms.
